NLRB-502 (UC) Unit Clarification Petition
Form NLRB-502 (UC)—the Unit Clarification Petition—is used by the National Labor Relations Board to evaluate whether to exclude certain employees and job classifications from an union's existing bargaining unit. Managers and supervisors are generally excluded from union membership because they have the authority to act on behalf of the employer in directing, hiring, firing, or otherwise managing employees. The rationale for barring supervisors from union membership is to prevent conflicts of interest that arise from the divided loyalties of a union member-supervisor, who, if permitted to join a union, will have irreconcilable duties towards both the union and the employer.
